This Manual has been prepared for the benefit of all unit owners. In order to preserve the environment of Snowater and to provide harmony in the utilization of its amenities, it is necessary to establish certain rules and regulations for its owners and guests.
We believe that Snowater is a comfortable and pleasant place to live and that we all take pride in this fact. Condominium living, of course, is a cooperative style of living and the Snowater Board of Directors encourages all owners to share a sense of responsibility for the complex and that each of us be mindful not to cause inconvenience to others so that we may live happily together. The Manager and the Board of Directors are open to constructive criticism and any suggestions that you may wish to bring forward. You, as an owner of Snowater, decide the appearance and how you want Snowater to be maintained. It is the owners of Snowater who direct, operate, and maintain their individual condominium and all of the common areas, buildings, and facilities. You are the ones who pay the bills. Your attention to something that is not right or any concerns you may have should be brought promptly to the attention of the Manager, a Snowater Director, or the Chairperson of your condominium building. Express those issues in writing, by phone or in person.
Paramount to each person’s thoughts and actions, when conducting himself/herself at Snowater, must be the consideration of others. Please be considerate and thoughtful when you are at Snowater. This is your home away from home. Please exercise care not to disturb your neighbors, particularly in the case of musical instruments, stereos, loud noises, etc.
Any violation of the by-laws, rules and regulations will be dealt with under the procedures as outlined in Section 6 herein.
Insurance coverage is maintained in accordance with the Condominium Act and a copy of the policy is available for inspection by any owner on request to the Board of Directors.
We urge each owner to read this Manual, along with the by-laws and the declaration for your building; as well, we encourage you to obtain a copy of the Condominium Act published by the State of Washington, which provides the guidelines for ownership in a condominium development.
This SNOWATER MANUAL is to be left in each unit, to have its contents known by family members, and to be readily available to guests and visitors.
SNOWATER IS INTENDED FOR CHILDREN, FAMILIES AND ADULTS. THE RULES AND REGULATIONS HAVE BEEN DEVELOPED TO BALANCE THE VARIOUS NEEDS OF EACH USER GROUP.
WHAT IS SNOWATER
Snowater consists of 174 individual condominiums in 15 condominium buildings. There are 78 lower 1-bedroom, 30 upper 1-bedroom, 60 upper 2-bedroom, and 6 lower 3-bedroom units.
The Snowater Association is the managing agent which oversees the governing of the entire complex. It is responsible for the safety, maintenance and insurance of all the common facilities and all of the common grounds. The Association’s Annual General Meeting is held at Snowater on the first Saturday in December. At this meeting the Snowater Board of Directors is elected.
Each condominium building is a separate Condominium Association and the individual owners in each condominium building are responsible for the affairs of their own Condominium Association. A chairperson and a secretary are elected at the Condominium Association’s Annual General Meeting held at the same time as the Snowater Association AGM. Each Condominium Association is responsible for the safety and maintenance of its building and the grounds extending ten (10) feet in each direction from the building.
Individual condominium owners are responsible for the safety, maintenance, and contents and liability insurance of their respective condominium.
The Snowater Timeshare Association is a sub-association responsible for administering the 43 timeshare condominiums. Its directors are elected at an Annual General Meeting of the timeshare owners held in June of each year, usually in Bellevue, Washington. The Equinox, White Rapid and Clearwater buildings are one hundred percent (100%) timeshared ownership, together with one condominium in Saw Pit and four condominiums in Trapper. Each timeshared condominium has 12 ownerships, called “segments”. Each segment comprises four separate weeks of ownership. Usage is arranged so that ownership is allocated one week of use every 12 weeks.
Interval International Exchange privileges are granted to fullshare owners at Snowater. Any fullshare owner may become part of this program by meeting the qualifications set out by the standards and guidelines of the Snowater Exchange Committee/Snowater Owners Association (SEC/SOA).

EMERGENCY SERVICES
IN CASE OF EMERGENCY — DIAL 911
(No coin is required)
TELEPHONE LOCATIONS:

A FIRE ALARM and fire extinguishers are located on the outside of each building. You should become familiar with these locations.
THE FIRE ALARM SYSTEM may be used for an emergency, and is monitored for assistance from Emergency Services outside Snowater.
Pulling the handle will result in a loud siren, which is located on the 200 building on the end nearest the office.
If an alarm sounds, leave the building immediately and go to the office. The alarm control panel is located in the office storage room and is ONLY accessible to homeowners while the office is staffed. Emergency Services are automatically notified of the location at which the alarm was pulled. After pulling the alarm, 911 should be called to give details of the nature of the emergency. Otherwise, the Fire Department will be dispatched with fire fighting apparatus.
Stay out of the way, but be prepared to help if requested. Return to your condominium only after the emergency has passed.

MEDICAL EMERGENCY CALL BUTTONS are located on the outside of the Club House and Recreation Building beside the Fire Alarm. Pushing the button will immediately alert Emergency Services. After pulling the alarm, 911 should be called to give details of the emergency.

SECTION ONE – COMMON AREA FACILITIES
The Adult Center, Clubhouse, Recreation Building, Manager’s Residence, Workshop, Tennis Courts, Basketball and Sports Courts, Picnic Shelters, and common facilities and surrounding grounds are owned and cared for by the SNOWATER ASSOCIATION on behalf of all the condominium owners.
1.01 ACCESS is controlled as follows:
The Entrance Access Card allows entry to the main gate and to the front doors of the Clubhouse and the Recreation Building.
The gate security rail mechanism allows ONLY ONE VEHICLE TO ENTER AT A TIME.
For security purposes, a maximum of three Entrance Access Cards per condominium may be issued. Anyone who finds an Entrance Access Card should promptly turn it over to the Snowater Manager. If an Entrance Access Card is lost or missing, please notify the Manager immediately and the card will be cancelled. A replacement Entrance Access Card may be purchased for $25 through the Manager.
The RED magnetic coded key stamped with an “X” provides access to the Exercise Room in the Recreation Building, the Adult Recreation Game Room in the Clubhouse, and the Adult Center/Heritage Log Cabin. These ADULT facilities are for the exclusive use by persons 21 years of age and older and are posted as such.
Do not give the RED magnetic key to persons under 21 years of age. If a RED magnetic key is found on a person under the age of 21, it will be confiscated and taken to the Manager. The Snowater Board of Directors will determine under what conditions and when the RED magnetic key will be returned to the owner.
Anyone who finds magnetic keys should promptly turn them over to the Snowater Manager. Replacements may be obtained from the Manager for a $25 fee.

MANAGER’S RESIDENCE is for the sole purpose of the Manager as determined by the Snowater Board of Directors.
1.03
OFFICE AREA is divided into two offices:
Snowater Timeshare Association and their staff occupy the front office, which is open seven days a week from 10:00 A.M. to 5:00 P.M. On Friday evenings the office is open until 10:00 P.M. The Timeshare telephone/fax number is 360-599-2724.
Snowater Association and the Manager operate from the rear office. The Manager or Caretaker is normally on site doing maintenance from 8:00 A.M. to 5:00 P.M. seven days a week. Telephone number is 360-599-2640. If no one is available in the Snowater Office, please leave a message. Snowater Timeshare staff at the front office desk will endeavor to assist fullshare owners with problems regarding the entrance gate, etc. but do not have the ability to deal with all Snowater Association problems and services.

MAIL SERVICE is available at the Post Offices in Glacier and Maple Falls. They offer post office boxes for a nominal fee. Personal mail that is sent to Snowater via the Snowater P.O. Box 5068, WA 98244 is picked up by the Snowater Manager and placed in the mailroom in open bins marked alphabetically “A” through “Z”. Snowater assumes no responsibility for mail or packages delivered through its P.O. Box number. The Snowater Association prefers that owners arrange for their own personal P.O. Box. Courier packages will be delivered and placed in the mailroom but Snowater Association and its staff does not accept responsibility for their safekeeping.

MAINTENANCE BUILDING is for the exclusive use of the Manager and those persons performing a function for Snowater under his supervision. There is a portion of this building designated as SNOWATER OWNERS’ WORKSHOP for the exclusive use by the owners. A key to this workshop is available from the Snowater Office.

SNOWATER GROUNDS are a major part of this incredibly beautiful development with a heavy emphasis given to a love for nature and family-oriented activities. Each owner is ultimately responsible for the care of the grounds so that all may enjoy the safety and beauty of our property.
1.07
SNOWATER FACILITIES cannot be reserved by individual condominium owners for the owner’s exclusive use except as noted below. While a family or group may make use of other areas for a particular purpose, it cannot be at the exclusion of other owners.
An owner may reserve the kitchen facilities in both the Clubhouse and the Heritage Log Cabin (Adult Center) by “booking” these facilities up to a week in advance, subject to Board-sponsored events. Such a request must be made to the Manager. The area must be returned to its normal condition or a housekeeping charge will be assessed.

BARBECUES & PICNIC SHELTERS are open to all owners and their guests on a first-come-first-served basis. Be sure your fires are extinguished/out when you leave the area. For your convenience, garbage containers are located in all areas. For fire safety, barbecues are not permitted on decks/balconies, stair landings, in fireplaces or on patios. During very dry weather conditions use of barbecues may be curtailed.

SOCIAL FUNCTIONS are sponsored by the Snowater Association during the year, such as spring and fall highway clean-up, barbecue and dance on July 1/4 and Labor Day weekends and a New Year’s Eve party. Details are published in the quarterly Snowater Newsletter and posted in the office.

CHILD CARE services are not available at Snowater. However, office staff may be able to provide references to local residents who are available to child care.
SECTION TWO – INDOOR RECREATION
2.01 RECREATION BUILDING contains a pool with jacuzzi health spa, two handball/racquetball courts, change rooms, viewing lounge, weight/exercise room, family game/recreation room and two (upper and lower) sun basking decks. The building has been designated as a smoke-free area.
Access to the Recreation Building is via the Entrance Access Card.

Hours are from 8:00 A.M. to 10:00 P.M. seven days per week. Please allow sufficient time to change prior to closing time. NOTE: Tuesdays and Fridays are designated cleaning days.
2.01.2
Swimming Pool area is unsupervised and there is no lifeguard on duty ever. It is open to all family members and invited guests. Parents/Owners are completely responsible for supervising their children and their guests. No more than eighty (80) people shall occupy the pool at any one time. Washington State Health Law requires that the temperature in the pool be maintained at a constant 29C/84F.
CHILDREN 12 AND UNDER MUST BE UNDER THE DIRECT SUPERVISION OF A RESPONSIBLE PERSON 21 YEARS AND OLDER.
No tag and/or chase games, roughhousing, throwing objects and/or persons into the pool are allowed in the pool area. Only those floatation devices such as life jackets and arm sleeves that can be worn are allowed. The use of floatation devices such as inner tubes or air mattresses is prohibited.
NO FOOD OR DRINK IS ALLOWED IN THE POOL/JACUZZI AREAS OR CHANGE ROOMS.
Soap, shampoos or oils are not allowed in the pool area. When they are used and find their way into the pool (or jacuzzi) they clog up the filter systems. This prevents the proper amounts of chemicals from entering the pool or jacuzzi and the equipment may fail.
2.01.3
Jacuzzi Health Spa and pool are treated with chlorine and other chemicals for your safe enjoyment. You can help limit the amount of chemicals used by showering each time before entering the pool or jacuzzi. No more than ten (10) people shall occupy the jacuzzi at any one time. To comply with Washington State Health Law, no child under the age of seven (7) is allowed or permitted in the jacuzzi health spa. Pregnant women are cautioned against using the jacuzzi. Washington State Health Law requires that the temperature of the jacuzzi be maintained at a constant 39C/102F.
2.01.4
Appropriate Swimwear must be worn in the swimming pool and jacuzzi. All footwear is prohibited in the pool area. Please read and comply with the rules located in the dressing rooms and pool area.
2.01.5
Emergency Equipment for your safety is located around the pool and is for emergencies only.
2.01.6
Family Game Room is equipped with table tennis (ping-pong) and billiards (pool). Pool cues and balls, table tennis paddles and balls are available at the office. You may sign for the equipment for two-hour periods by depositing $5.00 and providing identification. When you return the equipment to the office your $5.00 deposit will be returned. Equipment that is checked out within a half-hour of closing time is required to be returned to the office by 10:00 A.M. the following morning.
2.01.7
Exercise Room is for persons 21 years and older. Teens are allowed to use the equipment if they are accompanied by a responsible person 21 years and older. If you have questions about the equipment, ask at the office before using the equipment. The equipment consists of two stationary bicycles, a stair-stepping machine, treadmill and weight machine. Please use this equipment with care.
Access to the Exercise Room is with a specially coded magnetic key painted RED and stamped with an “X”.
2.01.8
Handball/Racquetball courts playing times may be booked by using the sign-up sheet on the clipboard for each court. Time is reserved on a first-come-first-served basis. Only one court time may be reserved per day per unit. If people are waiting to use the court, be considerate. It is intended that the players allow for court changes on the hour and half-hour. The maximum time for court use is 30 minutes when other players are waiting to use the court. Wear only clean, dry, non-marking court designed shoes. All players MUST wear eye guards. Each player is completely responsible for determining that the courts are safe to use and free from any dangerous foreign material.
NOTE: A basketball hoop is installed in Court #1.

Sun Basking Deck is located outside the main entrance to the Recreation Building. During the summer months adjustable chaise lounges are provided for your comfort and convenience. A second sun basking deck is located on the south side of the pool facing the large play field. To comply with Washington State Health Law, there is no access to the pool from this deck.
SECTION TWO – CLUBHOUSE BUILDING
2.02 CLUBHOUSE contains a swimming pool, jacuzzi health spa, dry sauna, change rooms, adult lounge/game room, kitchen with stove, refrigerator and microwave, meeting/lounge area, Kids Korner, mezzanine, squash court, handball/racquetball court and two sun basking decks. The Clubhouse has been designated as a smoke-free area.
Access to the Clubhouse is via the Entrance Access Card.
2.02.1

Dry Sauna is located off the hall across from the change rooms. The light switch and temperature control/timer is located in the entry area to the sauna. The sauna is restricted to ten (10) people at one time. No one under the age of seven (7) is allowed in the sauna. Persons between the age of seven (7) and twenty (20) must be under the direct supervision of a person 21 years and older. Appropriate attire is required at all times.
2.02.7
Adult Lounge Game Room provides a place for persons 21 years and older to enjoy both table tennis (ping-pong) and billiards (pool). The equipment is left in the room and does not have to be checked in and out of the office. There are also a couple of sets of tables and chairs for those who wish to bring board games or cards.
Access to this room is with the specially coded magnetic key painted RED and stamped with an “X”.
2.02.8
Kitchen is located and just to the left of the main entrance to the Clubhouse. Access and use of the kitchen may be arranged by contacting the Manager at the office during normal office hours.
2.02.9
Kids Korner has furniture to fit the younger children. The space has been designed to fit their ages and needs. Outside there is also play equipment specifically to suit younger children. A housekeeping charge will be assessed if the condominium owner does not adequately clean up the room following its use.
Direct ADULT supervision is required of children at all times.
Admittance is with a key obtained from the office during regular office hours.
2.02.10
Sun Basking Decks — there are two sun basking decks adjoining the Clubhouse. One is the area on the roof over the handball courts. Access is just outside and to the left of the main entrance to the Clubhouse. The other area is just outside the pool. Access is through the dressing/change rooms then along the edge of the pool and through the door to the concrete deck. This area is fenced. Washington State Health Law mandates that persons must shower each time when entering the pool from this sun basking area and a shower is provided for your use. Failure to shower prior to using the pool causes the equipment to disperse more chlorine and chemicals into the pool.
During the summer months adjustable chaise lounges and chairs are provided for your comfort and convenience.
2.02.11
Squash and handball/racquetball courts are located in the Clubhouse. Follow the rules for your use and enjoyment of these courts. When using the courts, playing times may be booked by using the sign-up sheet on the clipboard for each court. Time is reserved on a first-come-first-served basis. Only one court time may be reserved per day per unit. If people are waiting to use the court, please be considerate. It is intended that the players allow for court changes on the hour and half-hour. The maximum time for court use is thirty (30) minutes when other players are waiting to use the court.
Wear only clean, dry, non-marking court designed shoes. All players MUST wear eye guards. Each player is completely responsible for determining that the courts are safe to use and free from any dangerous foreign material.
2.03
ADULT CENTER (Log Cabin) is sometimes referred to as the Heritage Log Cabin Its use is restricted to people 21 years of age and older and has been designated as a smoke-free area. The Adult Center is available on the same schedule of hours as other common area facilities, i.e. 8:00 A.M. to 10:00 P.M. seven days a week.
Access is via the special magnetic coded key painted RED and stamped with an “X”.
A life buoy, a river rescue throw bag and rope is located on the east side of the log cabin and is to be used for emergencies only. A telephone for internet connection is located on the second floor.
SECTION THREE – OUTDOOR RECREATION
3.01 TENNIS COURTS are restricted from 8:00 A.M. to dusk. The tennis courts have a special surface which require players to wear tennis court shoes only with non-marking soles. Bicycles, roller-skates, inline skates, skateboards, toys are prohibited. Courts are closed in the winter months for safety reasons and to preserve the surface during adverse weather conditions; they usually re-open in May.
The courts near the Clubhouse are available on a one-hour reservation per day per unit basis. There is a reservation sign-up sheet on a clipboard at the entrance to the courts.
The courts near the Adult Center/Heritage Log Cabin are “open” courts and available on a first-come-first-served basis BUT all players must change on the hour when others are waiting.
3.02
SPORTS COURT (located behind the 1200 building) area is lined with one half designated for basketball and the other half for volleyball, badminton, pickleball, paddleball and in-line skating. In-line skates are the only wheeled devices allowed on these courts when they are not being used for other activities. No bicycles, skateboards, etc. are allowed on the court. Hours are restricted from 9:00 A.M. to dusk. There is no time limit for the use of the sports court other than common sense and courteousness when others are waiting.
3.03
CHILDREN’S PLAYGROUND has equipment for younger children and is located across the entrance road from the Manager’s office. The horseshoe pits are located in this play field.
Direct ADULT supervision is required of children at all times.
3.04
PLAY FIELD is located behind the Recreation and 1200 Buildings and adjoining the sports court. There are picnic tables and barbecues adjoining this area.
3.05
TRAILS AND PATHS are for pedestrians and joggers. MO-PEDS, MOTORCYCLES OR ANY OTHER MOTORIZED VEHICLES ARE PROHIBITED, except those Snowater and/or emergency vehicles required for either maintenance or emergency purposes.
BICYCLES, ROLLER-SKATES, IN-LINE SKATES, SKATEBOARDS, ETC. ARE PROHIBITED ON FOOTPATHS. Their use is restricted to the paved areas.
3.06
ROADS are for pedestrians, cars and bicycles. All baseball, football, throwing of balls, frisbees, etc. and any other running games are restricted to the sports courts, playgrounds and playing fields.
SECTION FOUR – DOMESTIC PETS
4.01 PETS MUST BE RESTRAINED BY A LEASH when outside of a condominium. No dog shall be left unattended when outside the confines of the owner’s Unit*. Fines will be imposed by Snowater Association for violations as described in Section 6. Pets are not allowed in any of the common area buildings, sundecks or outdoor courts. (*Amended June 21, 2003)
4.02
PET OWNER’S RESPONSIBILITY/LIABILITY. The animal’s owner is responsible for any personal injury or any damage to Snowater property caused by their pet.
4.03
PET WASTE is the responsibility of the pet’s owner. A supply of Teddy Bags for dog waste are located at the Recreation Building, Clubhouse, Adult Center and Main Office. Waste disposal containers are located throughout the property.
SECTION FIVE – MISCELLANEOUS RULES AND REGULATIONS
5.01 GUEST REGISTRATION. Owners must pre-register all visitors and guests with the Manager. Without prior approval by the owner, the Manager is instructed to refuse the issuance of Entrance Access Cards and/or keys to anyone other than the owner on record.
Guest registration forms are available from the Manager at no cost to the owner. A temporary Entrance Access Card can be issued for a limited time at the discretion of the Manager. A deposit fee of $25 will be charged.
The maximum number of day requests is limited to six (6) per owner unless approved in advance by the Snowater Manager.
5.02
OWNERS’ LIABILITY. Snowater owners are responsible and liable for their children and guests. Owners should make their guests and visitors aware of the rules and regulations contained in this Snowater Manual.
Owners must ensure that their children and their guests keep the noise level to a minimum, particularly between the hours of 10:00 P.M. and 8:00 A.M.
Owners are responsible for the supervision of their children and guests in the common areas of Snowater.
Cost of repair for damage incurred to an owner’s property or to the common property committed by an owner, their children or their guests will be the responsibility of the owner whose children or guest(s) committed the damage.
5.03
SMOKING/DRINKING RESTRICTIONS. Smoking is prohibited in all common area buildings. Drinking is not permitted around pools, jacuzzis, in the change rooms, sauna or court areas. Glassware is not permitted on the sun basking or pool decks.
5.04
PARKING is allowed only in designated areas next to buildings. Vehicles parked on trails or paths, or blocking designated fire lanes or roads will be removed at the owner’s expense.
A designated area is provided north of the Captain Jack (900) and Lulu (600) buildings for trailers, RVs and vehicles in excess of 22 feet. There are no servicing facilities for recreational vehicles at Snowater, therefore sleeping in vehicles is strictly prohibited.
No vehicle may be left on site unattended or unused for a continuing period in excess of one month without the Manager’s written approval.
All vehicles must be licensed for use on Washington State highways.
5.05
DRIVING VEHICLES/OTHER EQUIPMENT. When driving vehicles or other equipment, always be on the alert for small children and other pedestrians and observe the 10mph/15kph speed limit on Snowater roads. Vehicle license plate numbers should be registered with the Manager for the security of all owners. See Section 5.01 above.

ARCHITECTURAL CONTROL is established and maintained by the Snowater Board of Directors and/or by an appointed architectural control committee.
5.06.1
Doors/screens exposed to the exterior of any building shall be made of wood and stained as provided by Snowater or as approved in writing by the Board of Directors. Doors/screens must be maintained in good condition (no torn screens or faded stain).
5.06.2
Antennas/structures or any other apparatus shall not be placed on the exterior of any building or on the grounds of Snowater without the prior written permission of the Snowater Board of Directors.
5.06.3
Wood shall not be stored on the decks/balconies or grounds without the written permission of the Snowater Board of Directors.
5.06.4
Signs or other forms of communication will not be permitted on the exterior of, or visible from, any condominium unless the Snowater Board of Directors grants approval.
A Community Notice Board located outside the Snowater Office is provided for owners. Any owner may place a 3″ x 5″ file card on the notice board announcing:
0. An intent to sell a condominium or other personal property.
0. An interest in purchasing a condominium or other personal property.
The file card shall be dated and posted for three (3) months, at which time the file card will be removed unless renewed by the owner.
Other items permitted on the Snowater Notice Board include:
0. Information on things to see and do in the Pacific Northwest.
0. Upcoming events, i.e. social events, meetings, Adopt a Highway, etc.
0. Photos of past Snowater community events.
0. Newsletter
0. Scheduled property improvements
0. Real estate listings of Snowater properties
0. Real estate agents
Snowater Association does not participate in either the rental or sale of condominiums or other personal property. The Community Notice Board is for the sole use of Snowater Timeshare and Fullshare owners, and real estate agents acting on their behalf. The Snowater Manager must insure community notices meet the above requirements before being posted on the notice board.
5.06.5
Decks/balconies are to be kept clear of unsightly materials such as towels, bathing suits, sleeping bags, and wood. They are not to be used as a storage area. Skis, bikes, wood, etc. must be stored either inside the condominium or in the condominium entry storage area.
5.06.6
Window cover exteriors (drapes, curtains, blinds, etc.) shall be either white or beige/earth tone materials which blend with the color and composition of the exterior surface of the building.
5.06.7
Motion detector lights must be installed by a registered State of Washington contractor and to the Snowater specifications that are available from the Snowater Manager.
5.07
LITTERING anywhere on site at Snowater is not acceptable and is prohibited.
5.08
PRESERVATION OF THE ENVIRONMENT is paramount to the enjoyment of Snowater. No tree, shrub, bush, plant, or flora or fauna may be cut, trimmed, topped or removed without the express written permission of the Snowater Board of Directors. Only such trees, shrubs, plants, flora or fauna which are native, natural or indigenous to the area may be planted on the common grounds of Snowater and on the common grounds of the individual condominiums and then only by prior written approval of the Snowater Board of Directors.
A Forest Management Committee and a Landscape Committee consisting of volunteer owners assists the Board of Directors in identifying trees/shrubs to be removed/replaced.
5.09
GARBAGE AND RECYCLE BINS are located at the foot of the hill and to the south of the 1500 (Clearwater) building. This area is lighted and a garden hose is located there. In case of fire call 911, then notify the Manager. Follow the emergency procedures outlined at the beginning of this Manual.
All garbage must be placed in sealed plastic bags and disposed of within the provided dumpster. Do not discard furniture or other personal property in or around the dumpster. Violators will be charged a separate fee and penalty as established by the Snowater Board of Directors. There is a pick-up site westerly of Glacier, on the northerly side of the road, where you can take these larger items of personal property. Preferably, make arrangements for the items to be recycled if they are clean and reusable.
A metal 55-gallon barrel is provided for disposing of fireplace materials.
Recycle receptacles are provided for:
- newspapers
- mixed paper
- glass, tin and plastic
- cardboard only
- aluminum cans
5.10
Television access at Snowater is currently available for full shareowners on a limited, user-pay basis, enabled by a Direct TV satellite dish system. Service is not available in the three Snowater Time Share Association buildings (1100, 1400 and 1500). The Snowater Telecommunications Committee (STC) coordinates arrangements for access, including new installations, service activation and maintenance. This Committee represents Snowater owners who currently subscribe to television service. By agreement with Snowater Association, active subscribers bear all financial responsibility for television infrastructure and service. Internet access service is not available through this system.
Expense falls into two categories: (1) an entry fee (currently $300) to the Snowater Telecommunications Committee; and (2) individual hook up, equipment (e.g. satellite receiver) and installation costs. These latter costs will vary depending on connection circumstances, current prices for equipment and the TV channel packages selected by a subscriber.
The procedure for participation in this Snowater television network involves two steps: first, payment of the entry fee to Snowater Association; and second, arranging for the actual installation. Once the entry fee has been received and processed, the Chairperson of the Telecommunications Committee can authorize installation. Most recent installation costs (late 2003) ranged from $300-$350, including labor, equipment and materials. The installer can also assist in setting up the account with Direct TV. Early in 2004, a standard channel package costs about $33 per month (including local channels, CNN, A&E, History, ESPN, etc) but go higher as specialty and premium movie channels are added.
If you are a Snowater owner wanting to subscribe, you should first contact the Chair of the Satellite Telecommunications Committee in care of Snowater Association, to indicate your intent and verify the current entry fee. Next, your entry fee payment should be mailed or delivered to Snowater Association (attn: Account 220). The installer can then be authorized to arrange access to your building and unit for the necessary work. Approximate installation and hook up charges can be estimated in advance by contacting Audio Visual Excellence in Bellingham, WA (360-398-8447). Be sure to indicate that you are a Snowater owner. The location of your unit, including whether you have a lower or an upper unit and your distance from the building’s signal distributor, can make a slight difference in cost. Tom Davis, Snowater Manager, will also need to be advised about any installation date so that building and unit access for the AV Excellence installer can be arranged.
5.11
BOUNDARY OF AN INDIVIDUAL APARTMENT is defined in the Condominium Declarations Section 4.01. Snowater Association has detailed this definition as follows:
Electrical: – wiring in perimeter walls, floors and ceilings are common property.
- wiring in interior walls leading to an apartment is that apartment owner’s property; however, any wiring in interior walls which leads to another apartment is common property.
- – outlets, switches, baseboard heaters, etc. are the apartment owner’s property.
Plumbing:
- piping in perimeter walls, floors and ceilings is common property.
- piping in interior walls leading to or from an apartment is that apartment owner’s property; however, any piping in interior walls which leads to another apartment is common property.
- the water turn-off valve for an apartment is the apartment owner’s property.
- plumbing fixtures and all components of their connection to the piping are the apartment
- owner’s property, even if the connection components extend into the perimeter wall, floor or ceiling (e.g. the entire bathtub P-trap is the owner’s property including the connection nut at its exit to the waste pipe). (Note: Current legal council has put this into question.)
Fireplaces:
- the flue is common property
- the fire box, including damper and screen, is the apartment owner’s property.
Interiors:
- property of the apartment owner; however, structural modifications cannot be made without approval of the Snowater Board of Directors as such modifications may affect safety of common property.
SECTION SIX – FINES AND ASSESSMENTS
The Condominium Act gives the Board of Directors the exclusive power to control, manage and administer the common property, common facilities and other assets of the Association for the benefit of all owners.
Dealing with breaches of the by-laws, rules and regulations is often rather awkward and enforcing them is sometimes difficult and unpleasant. There is a delicate balance between the desire to enforce the by-laws and rules and regulations and the desire to maintain good relationship amongst neighbors.
It must be realized by the owners that the Board of Directors’ role is one of recommending and establishing by-laws, rules and regulations and taking appropriate action to enforce these and is not one of policing the development.
Owners should not abdicate to the Board of Directors their individual responsibilities as property owners.
Procedure for handling complaints and violations of by-laws, rules and regulations:
If you are involved in or witness a serious offence occurring to persons or property, you should contact the police directly.
If you have a complaint or witness a breach of the Association’s by-laws, rules and regulations, you should:
1. Speak directly to the person responsible.
2. Advise the Snowater Manager, or
3. If the problem persists or is of such a nature that you do not wish to become actively involved, refer the matter, in writing, to the Manager with a copy to the Board of Directors.
Upon becoming aware of the breach of the Snowater Association by-laws, rules and regulations, the Manager or the Board of Directors may take one or more of the following actions:
1. Solicit an explanation from the violating owner(s), guest(s) involved.
2. Advise the specific owner(s) of the violation or problem via personal letter and ask for and/or demand compliance or correction.
3. Grant exception to a by-law, rule and regulation.
4. If the violation persists or is of a serious nature, take appropriate action, i.e. letter of warning, fine, corrective work or action charged to the owner or court action.
The following fines and/or assessments may be charged for each contravention of the by-laws and rules and regulations. Unpaid fines will be added to the owner’s quarterly assessment invoice. If fines are not paid in a timely manner, the owner’s Entrance Access Cards will be cancelled. If quarterly assessments are not paid in a timely manner, the Snowater Board of Directors may place a lien on the offending owner’s apartment.
Note: All fines and assessments are to be paid in U.S. Funds.
6.01 An Entrance Access Card found in the possession of a person who is not an owner or a registered guest will be confiscated and cancelled. A replacement Entrance Access Card will be issued to the registered owner for a replacement fee of $25 for the first offence. The fee for any subsequent offences will be set by the Board of Directors.
6.02
A RED magnetic key found in the possession of a person under the age of 21 years who is found to be in a location restricted to the use of Adults Only, will have the RED magnetic key confiscated. The key will be returned to the adult owner with a record of the violation noted. Further violations will result in escalating fines of $25, $50, $75 and $100. Thereafter, the matter will be reviewed by the Board of Directors.
6.03
A minimum assessment of $100 will be levied against anyone breaking the gate rail. Any additional costs caused by the damage to the entry gate, the gate mechanism or the gate accessories will be assessed against the registered owner(s).
6.04
The Manager will assess a minimum $25 housekeeping fee to owner(s) using facilities such as the kitchen in the Clubhouse or Heritage Log Cabin if they fail to leave the facilities in their normal condition. Any additional costs will be charged on an hourly basis at the current housekeeping fee.
6.05
The Manager will assess a minimum $25 housekeeping fee to owner(s) if they do not adequately clean up the Kids Korner room following its use and prior to returning the keys. Any additional costs will be charged on an hourly basis at the current housekeeping fee.
6.06
$25 fine for each contravention of rules and regulations pertaining to bicycles on trails and paths. $100 fine for each contravention of rules and regulations pertaining to motorized vehicles on trails and paths.
6.07
$25 fine for the first infraction of rules and regulations pertaining to pets. Further infractions will result in escalating fines of $25 for each additional infraction.
6.08
Violators will receive a warning from the Manager. No attention paid to a verbal warning will result in a $25 fine for each contravention.
6.09
Vehicles parked on trails or paths or blocking designated fire lanes and roads will be removed at the owner(s) expense and liability. Abandoned vehicles will be towed at owner(s) expense and liability.
6.10
$25 fine for each month in contravention of architectural control rules (except signs – see Section 5.06.4) until the matter has been rectified to the satisfaction of the Board of Directors.
6.11
$25 fine for each contravention of rules and regulations pertaining to littering anywhere on site at Snowater.
6.12
$25 fine for each contravention of rules and regulations pertaining to the preservation of the environment.
6.13
$25 fine for each contravention of the rules and regulations pertaining to garbage disposal.
6.14
A $250 fine may be imposed for a false alarm.
6.15
The Seller shall be charged a $100 fee for each Resale Certificate packet provided to the potential buyer of the condominium; concurrent with the resale fee, the Seller will be charged $75, which will be refunded when the Purchaser acknowledges receipt of keys and gate passes.
Quarterly maintenance assessments are set annually and approved with the budget at the Annual General Meeting held the first Saturday in December.
Any owner who is more than 90 days delinquent in assessments and related penalties and interest shall have their gate pass access revoked. Upon full payment of all outstanding assessments the gate passes will be reinstated.
